2.3 Professional Conduct

You agree to conduct all interactions with Kepulauan Roast, our partners, and Indonesian coffee producers in a professional, respectful manner. Harassment, discrimination, or abusive behavior will not be tolerated and may result in immediate termination of services.

2.4 Payment Obligations

When engaging paid services, you agree to pay all fees as specified in your service agreement. Payment terms, methods, and schedules will be outlined in separate agreements for specific services.

4.1 Sourcing Services

When using our coffee sourcing services:

• • You acknowledge that coffee availability, quality, and pricing are subject to harvest conditions and market fluctuations
• • We facilitate connections but do not guarantee specific outcomes or coffee characteristics
• • Sample evaluation is recommended before making purchase commitments
• • You are responsible for compliance with import regulations in your destination country

4.2 Consultation Services

For processing method and sourcing consultation:

• • Advice is based on our experience but does not guarantee specific results
• • Implementation of recommendations remains at your discretion and risk
• • We provide general guidance, not legal or financial advice

4.3 Cupping Sessions

For cupping and evaluation services:

• • Sessions must be scheduled in advance and are subject to availability
• • Samples presented represent current availability but may not be available long-term
• • Cancellation policies apply as outlined in service agreements

5.1 Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, express or implied. We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will meet your specific requirements or that they will be uninterrupted or error-free.

5.2 Limitation of Liability

To the maximum extent permitted by law, Kepulauan Roast shall not be liable for:

• • Indirect, incidental, special, consequential, or punitive damages
• • Loss of profits, revenue, business opportunities, or goodwill
• • Coffee quality variations due to natural factors beyond our control
• • Delays or issues in shipping, customs, or delivery
• • Actions or omissions of third-party producers, shippers, or partners

5.3 Maximum Liability

In no event shall our total liability exceed the fees paid by you to Kepulauan Roast for services rendered in the twelve months preceding any claim.

9.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Indonesia, without giving effect to any principles of conflicts of law.

9.2 Negotiation and Mediation

In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation is unsuccessful within thirty days, the parties agree to attempt mediation before pursuing formal legal proceedings.

9.3 Jurisdiction and Venue

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Jakarta, Indonesia. You hereby irrevocably consent to the personal jurisdiction and venue of such courts.

10.1 Termination by You

You may terminate your use of our services at any time by ceasing to access our website and notifying us of your decision. Termination does not relieve you of obligations to pay for services already rendered.

10.2 Termination by Us

We reserve the right to suspend or terminate your access to our services immediately, without prior notice, for:

• • Violation of these Terms and Conditions
• • Fraudulent, abusive, or illegal activity
• • Non-payment of fees when due
• • Any other reason we deem necessary to protect our business or interests

10.3 Effect of Termination

Upon termination, your right to use our services ceases immediately. Provisions regarding intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution shall survive termination.

11.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and Kepulauan Roast and supersede all prior agreements, understandings, and communications.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them valid and enforceable.

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms or delegate any obligations without restriction.
